Overview

This website and online store are operated under the CASSIUS brand by TUMUH SOLUTIONS LLC. Throughout these Terms, “CASSIUS,” “we,” “us” and “our” refer to TUMUH SOLUTIONS LLC. These Terms of Service (“Terms”) govern your access to and use of our website, online store, content, features and related services (collectively, the “Services”), including purchases made through the Services.

By accessing or using the Services, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping Policy and Return and Refund Policy. If you do not agree, do not use the Services.

Eligibility and account information

You must be legally capable of entering into a binding contract in your jurisdiction to make a purchase. If you allow a minor to use a device or account you control, you are responsible for that use to the extent permitted by law.

You agree to provide current, complete and accurate purchase and account information and to update it when necessary. You are responsible for maintaining the confidentiality of any account credentials and for activity carried out through your account, except to the extent caused by our failure to use reasonable security.

Products and descriptions

We make reasonable efforts to present products, colours, dimensions, capacities, materials and features accurately. Screen settings, lighting, manufacturing tolerances and measurement methods may cause minor variations. Approximate values are identified as such.

Product information is not intended to create a guarantee beyond any express statement we make or any warranty or consumer right that applies by law. We may modify or discontinue products, subject to obligations relating to orders already accepted.

Prices, taxes and payment

Prices and available currencies are displayed on the Site and may change without notice before an order is submitted. The total presented at checkout includes the product price, shipping charges and taxes collected at checkout, as applicable. International orders may also be subject to lawful import charges as described in our Shipping Policy.

You authorise us and our payment providers to charge the payment method selected at checkout for the total shown. We may correct an obvious pricing or description error before accepting or dispatching an order. If payment has already been taken for an order we cannot accept, we will issue a refund.

Orders and acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, product unavailability, a material pricing error, delivery restrictions or suspected resale or misuse. If we cancel after payment, we will refund the affected amount.

We may limit quantities on a reasonable and non-discriminatory basis. We do not guarantee that every product or variant will remain available.

Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Returns, statutory cancellations and refunds are governed by our Return and Refund Policy. Those policies form part of these Terms.

Intellectual property

The Services and their content—including the CASSIUS name and branding, text, graphics, photographs, videos, designs, layout and software—are owned by or licensed to TUMUH SOLUTIONS LLC and are protected by applicable intellectual-property laws. You may use the Services for personal, non-commercial shopping purposes only.

You may not reproduce, distribute, modify, publish, scrape, sell, exploit or create derivative works from the Services or their content without prior written permission, except where applicable law expressly permits.

Acceptable use

You may not use the Services to:

• violate law or the rights of another person;

• submit false, fraudulent or misleading information;

• distribute malware or interfere with the security or operation of the Services;

• attempt unauthorised access to accounts, systems or data;

• harvest personal information or use automated systems in a way that places an unreasonable burden on the Services; or

• impersonate another person or misrepresent your affiliation.

We may suspend or restrict access for conduct that reasonably appears to breach these Terms or threaten the Services, customers or third parties.

Third-party services and links

The Services are hosted by Shopify and may include third-party payment, delivery, social, analytics or other services. Third parties may have their own terms and privacy practices. Links to third-party sites are provided for convenience and do not imply endorsement. We are not responsible for third-party sites or services except to the extent required by law.

Feedback

If you voluntarily provide suggestions or feedback about CASSIUS, you grant us a non-exclusive, worldwide, royalty-free right to use that feedback to improve or promote our business, without identifying you publicly, unless prohibited by law. This does not transfer ownership of your personal information, which remains governed by our Privacy Policy.

Disclaimer

We aim to keep the Services accurate, secure and available, but the Site may occasionally be interrupted or contain errors. To the fullest extent permitted by law, the Services are provided on an “as available” basis and we do not promise uninterrupted or error-free access.

Nothing in these Terms excludes any express product commitment or any warranty, condition or consumer right that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, TUMUH SOLUTIONS LLC and its directors, officers, employees, affiliates and service providers will not be liable for indirect, incidental, special, exemplary or consequential losses arising from use of the Services where such losses were not reasonably foreseeable.

Where liability may lawfully be limited, our aggregate liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim. These limitations do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or any liability or consumer right that cannot be excluded or limited under applicable law.

Indemnity

To the extent permitted by law, you agree to be responsible for reasonable losses and costs arising directly from your unlawful misuse of the Services or your material breach of these Terms. This section does not apply to ordinary consumer use or limit any mandatory consumer protection.

Changes to the Services or Terms

We may update the Services and these Terms from time to time. The version posted when you place an order will govern that order unless a change is required by law or is expressly agreed with you. Changes apply prospectively from the stated effective date. Continued use of the Services after an update means you accept the revised Terms for future use.

Severability and waiver

If any provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

Entire agreement

These Terms and the policies expressly incorporated into them constitute the entire agreement between you and us concerning the Services and replace prior communications on the same subject, without excluding statements or rights that cannot legally be excluded.

Governing law

These Terms are governed by the laws of the State of New Mexico and applicable United States federal law, without regard to conflict-of-law principles. If you are a consumer, this choice does not deprive you of mandatory protections or the right to bring proceedings in a court available to you under the laws of your place of residence.
